Here in the US, a lot of companies are getting sued over patent
infringement for using shopping cart software (like Amazon.com--see
http://news.zdnet.co.uk/internet/ecommerce/0,39020372,39147408,00.htm).

If I use third party shopping cart software such as Ezimerchant and
the patent holders came after me, what is my liability? Would they go
after the makers of Ezimerchant for making the shopping cart program,
or after me for using the software? What is the best way for me to
protect myself?

Hmm interesting, way I seeit you're only liable for the product your
selling.

Otherwise they could sue your host, product supplier etc. etc.
