Opinions about this incident:

When I was writing a page for my site last week I was using another similar web
page as a guide. He has some HTML tables formatted a specific way that I wanted
to use (after I changed the colors, etc) and also the information that he had
on his page had many categories and I wanted to cover all the categories in my
page (in a different way of course). So i copied his whole page my page and
uploaded it to my web server. I then began to write a unique web page covering
the same topics that he covered. As of today I was partially done. So i had my
originial information on there and his information on my page. These pages were
uploaded to my server but were not linked or made public in any way.

Now . . .

the web site I copied sent me an e-mail today accusing me of copyright
infringement. Apparently Google had picked up my page and indexed it and it was
now showing up in search engines. He was understandably upset. And telling me
he was going to get a lawyer, etc.

I e-mailed him back telling him what I was doing. I was writing my own pages
while using his as an inspiration. It is very obvious that I had no intent to
copy his site. His site links to my site and there are thouands of visitos that
would notice my word-for-word copying of his information had I published it
like that. I even showed him 1 page where I had 90% the page written with my
own information. The page I wrote covered the same topics he covered but mine
was original. The other 10% of the page was his information which I hadn't
deleted yet.

There were 5 pages that I had copied information from and they were uploaded
about 1-2 weeks ago. I removed the pages today as a good faith effort that I
wasn't trying to harm him. My sites gets 500,000 page views a month and the 5
pages I copied from his site got 10-50 page views each. The web page were
clearly under construction and were a mess. To any rational observer it is
obvious that his information was not meant to become public but he still
insists on possibly suing me.

Considering there were no damages, could I get harmed by this?

You can't have it both ways, if you didn't copy the site then there's no

Mistake here....if someone writes you, don't answer, however, if you feel a
compelling need to answer write nothing more than you absolutely disagree
with his position and that's it, no examples, no defense...nothing more.

Last mistake...posting your position, your defense and your beliefs on a
public, archived forum....do you see the folly.

If you did the same to one of my clients' sites, I would advice them to
take you to court. If it was one of our own sites, we wouldn't be
talking right now - but my lawyer would be.

There is NO EXCUSE for stealing someones' design, even if you INTENDED
to change it. YOU put it online. The instant you dead that, you breached
copyright laws.

I only hope for your sake you can afford a good lawyer to defend your arse.

The sort of things you are liable for - breach of trademarks, use of
copyrighted designs beyond fair use, theft of intellectual property,
dilution of brand (which could be argued into direct loss of income,
regardless of the number of hits).... blah blah.

Stupid. Really stupid.

i wasnt copying his design. I simply wanted the code for a table he had. A
simple table where I was going to CHANGE the colors, etc. You cant copyright
the HTML code for this table

Check your original post. You clearly stated that there was 10% of your
site that was his content. He has every right to be annoyed. If you wanted
to copy the structure, you should have done it locally without putting it
on a publicly accessible machine.

Bingo!

Grabbing a few tags to help with the structure of his web page shouldn't
be a problem. The problem was posting work in progress on his server for
all the world to see. The OP should not have posted the page to his
server until ALL of the original content was removed (including
artwork), and probably a fair amount of markup, depending on how
creative the markup was.

Hopefully the offended party will be satisfied to see his content
removed from the OPs server.<!-- ~MESSAGE_AFTER~ -->

I think it's just the fact that you placed a copy of his original work
on your server without permission.

You can't copyright HTML tags, but you can copyright an arrangement of
tags which forms a page or an element of a page.

Based on your info, my opinion is that the guy overreacted. Doesn't mean
he was wrong though.

No, but I'd encourage you to put quotation marks around the 1.
