You only need to be able to meet sales tax requirements. If that requires a
DBA (fictitious name) then you'll need to do it.

As soon as you put a web site on-line, it is copyrighted. Doing a trademark
search and application is a very good idea. You only need the Federal.

http://tess2.uspto.gov/bin/gate.exe?f=tess&state=ra4ker.1.1 and
searching for names while you create a company name and web site is a double
good idea. Can save lots of problems later if you have to change the name
because you picked one that was already protected.
