All of the text from one of my web pages was copied and one of the
images was hotlinked and posted to one of the boards hosted by
phpbb-host.com.
I opened an account just to ask them to take it down. I asked the poster
(who is also a moderator) and then had to explain to him why it was
wrong. He hasn't removed it. I wrote to the owner/administrator of the
board and asked him to take it down. He ridiculed me and my web site in
a public post just for asking and he hotlinked the same image. These
stupid bastards actually think this is a "free speech" issue.
I replaced the hotlinked image with something they should have found
very embarrassing but it's still hotlinked. I gave them fair warning
that I was going to file a DMCA takedown with phpbb-host.com and they
ignored it.
So Monday I used the contact form at the site to send a DMCA takedown
notice and I also emailed it to email addresses I found in the whois
info for the site and for the host--which is the same person. I haven't
received any response--not even an acknowledgement.
OK, so it's only been two days, but how long should it take after I've
followed the procedures properly? How long do I wait and where do I go
from here if I don't get any action on this?

I'd do that if it weren't for the fact that this is a site with only a
couple of pages and they've taken all of the text from the main page.
I'm afraid that if I don't get this text removed Google and other search
engines will penalize my site instead of the asswipes who stole from me.
If I had your "PR" I could afford not to worry about it.

Hi Red,
nice one on changing the hotlink.
Like Matt, I think this is more widespread than we'd all like. You would
have thought that if there was any money to be made that there would be
lawyers looking for this type of plagiarism. Presumably there isn't any
money to be made by lawyers, so it just carries on ...
I've never done it, but I wonder whether identifying who the hosting company
is and approaching them might be worthwhile? Although I'm sure that
identifying the host could often be tricky.

A lawyer? Honestly, I don't know. I have been ripped off so many times
in the past, and have subsequently found this is normal business
practice in the West (illegal, but normal).

There are ways to prevent hotlinking, though I don't know how effective
they are. My host provides a simple utility to prevent it. I use it
because my website is one big photo album.

Identify the host and other upstream providers (by tracert for example).
Give them 7 days, then submit abuse reports - you will probably find that
they are breaking some upstream AUPs. Though getting anyone to respond,
might be difficult - I've had little success in the past - My query has
presumably been too insignificant to worry about, and I've never had the
money or the inclination to pursue the legal route.

long as I still have some options.
I just sent a complaint to the upstream provider: dmca RemoveThis @gblx.net
I tried to call the owner of phpbb-host.com using the phone number in
their registration info -- it was disconnected. Then I tried to call the
number listed for the host, galaxywave.net, which is the same person but
a different number -- also disconnected.
But the registrar is Godaddy, so I pulled a "Viper" and sent a complaint
to invalidwhois RemoveThis @secureserver.net
That ought to get some action from somebody.

"Thank you for your email concerning the domain name GALAXYWAVE.NET. We
will attempt to contact our customer and request that they update the
domain contact information."
"attempt to contact" ???
"request that they update" ???
Jeeze, with all of Viper's bragging on this subject, I thought for sure
that they'd be a lot more aggressive than that.

Email notice is often considered a courtesy notice.
We run a graphic arts studio. We've had exactly one instance where a host
took action on an email notice. We now send the host an email notice, hard
copy by normal mail to the business address, hard copy via certified mail to
the host listed 'agent of service' with certified notice to the up stream as
well.

I sympathize with you. I've never had content stolen like you did -
maybe my content isn't worth stealing? :0(
I think it's fair for GoDaddy (or any registrar) to give them a chance
to correct the invalid information rather than just disable the domain.
The biggest problem you'll face with the upstream provider will probably
be proving the content was copied from you, rather than you copying
their content then claiming it as your own.
If this doesn't work, I'd suggest getting an attorney to write a
strongly worded letter to them, CC'ing their upstream providers. It
shouldn't cost much to get a letter written, and you'd be amazed at the
action it gets.
However, if they're in a different country, they may just laugh at you
anyway, knowing it's very expensive to sue someone outside of your own
country.

I agree. I just thought the response I got from GoDaddy was rather
tepid.

They're in the US.
I don't need to pay a lawyer. I am very good at making official looking
letterheads.
And the text in this case is all boilerplate, so that won't be a problem
either.

My only reason for suggesting an attorney draft the letter is because
people tend to pay more attention to a letter when it's signed by "Joe
Blow, Esq. Attorney at Law" on legal firm letterhead.

[Q] Copyright notice - I have noticed that many webpages place a little copyright notice at the bottom...is this really necessary? I seem to recall something at some point which implied that copyright is simply assumed these days.
IE7 Did you notice the information bar? - My websites which contain a bit of javascript work perfectly well with IE7 online but when they are sitting on my computer being developed they all cause the information bar warning re scripts to pop up. I can't stop it! I can't seem to name them on the....
NOTICE: Troytec / Testkiller Guides, other post sales too - Anyone who has read my posts regarding sales of these Study Guides, just disregard them. I was not aware that it was illegal to sell it. So far I haven't made any sales of these guides so don't worry. In any case, now that I know...just don't.. |
