Post subject: Customer paid up, but the transaction is not yet acknowleged by RegSoft after 1

Hi, recently, i've a customer transaction with RegSoft.com, a
subsidiary of public DigitalRiver.com, that went into problems.

Apparently, the customer asked his company boss to pay by credit card.
1 month later when the bill came, his boss forgot about the
transaction and called the bank to find out. Without his knowledge,
the bank charged back on transaction resulting in a situation known as
LATE PRESENTMENT (see mastercard definition below). In the end, the
bank still treated the transaction as valid and debited him for it
100% fully.

RegSoft at first offered to redo the transaction, and asked for proof
or confirmation from the customer that they are buying the software.
I managed to get that confirmation for them within a few days from the
customer. After that, there was no news for them for 3 weeks despite
me repeatedly trying to contact them for 3 weeks. I tried to contact
their boss, Robert Verzera, but also to no avail, it's as though no
one is working.

I suspect they either cannot resolve the situation, or are waiting for
bank response, or simply ignore the issue.

My customer has paid for the transaction using their system, and i
can't collect my money. To me, i feel that i deal with RegSoft, i do
not deal with the bank. If the customer has paid up from his credit
card, i deserve to get paid, even if RegSoft can't sort out the issue
with the bank. Has anyone experienced such a problem, and managed to
resolve it?

What are my rights? Is there anyway to get RegSoft to take up
responsibility for the issue.



LATE PRESENTMENT is defined by mastercard as -

Late Presentment
The central Site processing date is more than 30 days after the
transaction date and the account is statused (i.e., closed due to
fraud, credit delinquency, death, or counterfeit).

(Note: A transaction may be processed late, i.e., more than 30 days
from the original transaction date, if the cardholder is responsible
for payment and if it is a legitimate transaction. However, issuers
can charge back if the account is statused, thereby allowing them to
collect on the Account).
